EXECUTIVE ORDER 2021-08
EXECUTIVE ORDER REGARDING THE PROCUREMENT OF ZERO EMISSION VEHICLES AND SUPPORTING EQUIPMENT

WHEREAS, all residents of the State of Illinois deserve a safe environment in which their communities can thrive; and,

WHEREAS, the overwhelming consensus of scientists is clear: the climate crisis is real, and must be addressed by public officials; and,

WHEREAS, the climate crisis presents a significant threat to our environment, health, wellbeing, livelihoods, and economic security; and,

WHEREAS, the State has committed to transition to a 100 percent clean energy economy to ensure that Illinois will not be left behind as the nation confronts the climate crisis; and,

WHEREAS, the State government must help lead the transition to a clean energy economy; and,

WHEREAS, the transportation sector is the largest source of emissions in the State; and,

WHEREAS, the State cooperates with units of local government in the procurement of vehicles; and,

WHEREAS, the conversion of government vehicle fleets to zero emission vehicles is essential to meeting the Paris Agreement’s goal of limiting global warming to below 2 degrees Celsius; and,

WHEREAS, zero emission and low emission vehicles also reduce levels of localized air pollutants that have been proven to have harmful health effects; and,

WHEREAS, it is important for the State to take action to reduce greenhouse gas emissions within its own operations;

THEREFORE, I, JB Pritzker, Governor of Illinois, by virtue of the executive authority vested in me by Article V of the Constitution of the State of Illinois, hereby order as follows:

  1. Definitions
  2. As used in this Executive Order, ”State Agency” means any office, department, agency, board, commission or authority of the Executive Branch of the State of Illinois under the jurisdiction of the Governor.

  3. Vehicle Procurement Program
  4. The State shall develop and implement a program for procurement of electric and other low emission or zero emission vehicles for State purposes. This program may take into account the needs of specialty, police and emergency vehicles.

  5. State Fleet Working Group
  6. The State shall establish a State Fleet Working Group. The State Fleet Working Group shall be convened by the Illinois Department of Central Management Services (CMS) and shall include representatives from the Illinois Department of Transportation (IDOT), the Illinois Environmental Protection Agency (IEPA), and the Illinois Commerce Commission (ICC). The State Fleet Working Group shall:

    1. Propose standard procedures, formulas or tools designed to assist State agencies in calculating projected lifetime vehicle costs, including fuel, operations, and maintenance costs, when replacing or planning to replace a vehicle, and to assist in accounting for these costs in agency budgets.
    2. Identify and pursue external funding and grant opportunities to finance the purchase of zero emission or low emission vehicles.
    3. Evaluate alternative financing options for State fleet vehicles including leasing, energy performance contracting, and other methods that could allow for more cost-effective deployment of zero emission or low emission vehicles.
    4. Evaluate the infrastructure needs, including the need for electric vehicle chargers, required to support the operation of State-owned electric vehicles.
    5. Propose a uniform process that allows fleet coordinators to replace vehicles before standard retirement age with zero emission or low emission vehicles if replacement is deemed to be cost effective.
    6. Develop a guide to assist agencies in adopting management practices for the operation, maintenance, and fueling of electric vehicles. The maintenance and fueling schedules of electric vehicles differ from gas-powered vehicles, necessitating new best practices for fleet management. The guide should consider potential cost savings from real-time or time-of-use electricity pricing when recommending best practices for electric vehicle charging schedules.
  7. Lifetime Vehicle Cost Analysis
  8. When evaluating costs associated with State vehicles, State agencies shall, whenever feasible, consider a vehicle’s projected total cost of ownership, including fuel, operations, and maintenance costs.

  9. Electric Vehicle Chargers for State Fleets, State Employees, and the Public
  10. CMS, in coordination with other state agencies, shall develop a plan to install electric vehicle chargers on State property, including in visitor parking lots at State facilities, for use in charging State fleet vehicles, as well as vehicles owned by State employees and members of the public. As part of this plan, the State Fleet Working Group shall explore opportunities to make electric vehicle chargers intended for State use also available for public use, where and when possible. The plan shall seek to utilize applicable funding from the Rebuild Illinois Capital Plan. All State agencies shall strive to incorporate electric vehicle charging as a tenant improvement for State-leased buildings, where feasible.

  11. Assisting School Districts in Procuring Zero Emission School Buses
  12. The Illinois State Board of Education shall collaborate with IDOT and IEPA to develop tools and provide information to assist school districts in assessing the benefits and costs of zero emission bus options when replacing school buses.

  13. Savings Clause
  14. Nothing in this Executive Order shall be construed to contravene any federal or State law or regulation. Nothing in this Executive Order shall affect or alter existing statutory powers of any State agency or be construed as a reassignment or reorganization of any State agency.

  15. Prior Executive Orders
  16. This Executive Order supersedes any contrary provision of any other prior Executive Order.

  17. Severability Clause
  18. If any part of this Executive Order is found to be invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The provisions of this Executive Order are severable.

  19. Effective Date
  20. This Executive Order shall take effect immediately upon its filing with the Secretary of State.
